specific courses by making a limited number of resources available to the
greatest number of people.
A wide variety of materials may be placed on reserve including instructor's
personal copies, photocopies, and library materials. Library materials include
circulating books, periodicals, and Reference books.
A reserve form must be completed and submitted with materials to be placed on
reserve. Reserve information can be searched in PALS using the instructor's
name, course name or number, title, and by key words in the title. This
information is taken from the reserve form that the instructor has completed.
It is extremely important for this information to be correct.
Students will need this same information to request reserve material when they come to the library. Please note that the author's name is NOT a search term in the PALS reserves module. TITLES. Titles include book or periodical titles and journal article titles. When the reserve material consists of lecture notes and old
exams the instructor is responsible for creating the title (Chapter 1:
lecture notes). Do not include the course number or course name in the
title. When submitting a journal article, use only the article's title, not
the full citation.
All photocopied material, subject to copyright restrictions, MUST have a complete
citation clearly written on the first page of the photocopy. The citation must
also be noted on the reserve form. Any photocopied material which does not have
full citation information will not be processed.
At the beginning of the semester there is generally a backlog of work. If ALL
materials are submitted with a reserve form they will be placed in a queue and
processed within 48 to 72 working hours. However, if the reserve staff has to
pull library books to complete your request, they will be pulled within 48 to 72
working hours and placed back into the queue. Once back in the queue it will be
an additional 48 to 72 hours before they will be processed.
During the normal course of the semester, reserve requests are processed within 24-48 hours. Please remember, we do not process reserve requests over the weekends. To determine if material is on reserve you can access PALS from your computer. Once you are in PALS type in RES <space> instructor's name <space> course number. If you have any question regarding accessing PALS please contact the Reference desk at 898-2817.
Materials not conforming to book or file format must stay within certain
parameters regarding size and weight. Please consult the reserve room supervisor
before placing these items on reserve.
Due to space and copyright restrictions it is necessary to limit the number of
copies placed on reserve to four. A fifth copy of journal articles, lecture
notes, and old exams can be held in the reserve office as a replacement copy.
Todd Library does not have a permanent reserve. At the end of the semester the
reserve room mails out usage statistics for materials on reserve. Please review
this information and notify the reserve room of any renewals for the next
semester. Statements are mailed to the box number which instructors provide on
the reserve form.
The reserve collection includes a wide range of material which falls into one of
two categories, copyrighted material (books and journal articles) and
uncopyrighted materials (lecture notes, old exams, etc.). Photocopies of
copyrighted materials may be placed on reserve pursuant to fair use provisions
of the U.S. Copyright Act.
FAIR USE: Under fair use it is not an infringement of copyright to photocopy copyrighted
works for purposes of teaching, scholarship, or research. However, the fair use
exemption does not automatically grant a faculty member the right to photocopy
copyrighted material for educational purposes. In accordance with the laws of
the United States (title 17, U.S. Code Sec. 107) there are four factors to be
used in determining fair use:
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the
copyrighted work.
GUIDELINES: The reserve room will be adhering to the standards of educational fair use
outlined in the U.S. House Report number 94-1476 "Guidelines on Multiple Copying
for Classroom Use." Multiple copies may be made by the teacher giving the course
for classroom use or discussion provided the copying meets the tests of brevity,
spontaneity and cumulative effect and each copy includes a notice of copyright.
The library will ensure that all photocopied material prominently displays a
notice warning that the material is protected by copyright Law (Title 17 U.S.
Code).
1.) BREVITY A. A chapter from a book. B. An article from a periodical or newspaper. C. A short story, short essay, or short poem D. A chart, diagram, cartoon, drawing, or picture from a book, periodical,
or newspaper.
2.) SPONTANEITY A. The copying is at the instance and inspiration of the individual teacher. B. The inspiration and decision to use the work and the moment of its use for
maximum teaching effectiveness are so close in time that it would be
unreasonable to expect a timely reply to a request for permission.
3.) CUMULATIVE EFFECT A. The copying of the material is for only one course. B. Only one short poem, article, story, essay or excerpt may be copied from the same author. C. Only three short poems, articles, stories essays or excerpts may be copied from the same collective work or periodical volume during one class term. D. There may be only nine instances of such multiple copying for one course
during one class term.
NOTE: Photocopies of copyrighted material can be placed into the reserve
collection only when a member or unit of the MTSU educational community (library,
instructor, department) has a legally acquired copy of the original work.
PROHIBITIONS:
1. Copying is not to be used to create, replace or substitute for anthologies, compilations or collective works. 2. Copying of or from works intended to be "consumable" in the course of study or teachings not allowed. These include workbooks, exercises, standardized tests and test booklets, answer sheets and like consumable material. 3. Copying is not: a.) a substitute for the purchase of books, publishers' reprints or periodicals; b.) to be repeated with respect to the same item by the same teacher from semester to semester. 4. There can be no charge made to the student beyond the actual cost of the photocopying. 5. Only four copies of each item can be placed on reserve.
These guidelines apply only to photocopies which are made without permission from
the copyright holder. It is the instructor's responsibility to obtain copyright
permission.
ALTERNATIVES:
- Journals, periodicals, newspapers, and personal copies can be placed on reserve. - Acquisitions will order books, not currently owned by the library, if they are needed for reserve room use. - We have compiled a listing of the MTSU Library journals that offer blanket permission for photocopying. - Information on the Copyright Clearance Center (CCC) can be accessed through CCC
